On January 30th, 2023, the Biden Administration announced its intent to end the national emergency and public health emergency COVID-19 declarations on May 11, 2023. The declarations were put into effect in early 2020 and allowed the federal government to modify and waive certain requirements within Medicaid, Medicare, CHIP programs, private health insurance and more. Congress created legislation to provide additional flexibilities for the emergency declarations including: American Rescue Plan Act (ARPA), the Coronavirus Aid, Relief, and Economic Security (CARES) Act, the Consolidated Appropriations Act 2022 (CAA, 2022), the Consolidated Appropriations Act 2023 (CAA, 2023), the Families First Coronavirus Response Act (FFCRA), and the Inflation Reduction Act (IRA). While some flexibilities are scheduled to expire, CMS continues to evaluate whether others should be extended or made permanent.
